In order to be eligible for Service-Connected Disability Compensation, you must be a veteran, or a “person who served in the active military, naval, or air service, and who was discharged or released therefrom under conditions other than dishonorable.” 38 U.S.C § 101(2); 38 C.F.R § 3.1(d); [VBM 2.2]

Further, you must show that:

You currently suffer from a disability. In most cases, you must have an official diagnosis from a medical professional.

You sustained an injury, developed an illness or aggravated a condition during your military service. The Veterans’ Administration will consult their records, but there is no requirement that your account be documented in military records. That means that there must be medical records confirming the medical condition and its link to the time period of your active service.

Your disability is the result of the incident or event that occurred during your military service. There are several ways to accomplish this. Our attorneys can help you determine whether your disability and the incident render you eligible.
